Withdrawal policy

This policy applies to consumers. It explains how you withdraw from a contract for Dory, by when, and when the right of withdrawal lapses early.

Who this applies to. Under the law, a right of withdrawal is available only to consumers, that is, natural persons who enter into the contract for a purpose that can be attributed predominantly neither to their commercial nor to their self-employed professional activity (§ 13 BGB). Dory is aimed at organisations. We give this notice anyway, because whether someone is a consumer depends on who they actually are, not on what was ticked when ordering.

Which contracts this policy applies to#

Every order is a separate contract with its own period:

  • the subscription contract, which comes about when you choose a plan and place an order with an obligation to pay;
  • every purchase of credits on top.

The free trial is free of charge. Nothing is bought and nothing is paid, so there is no right of withdrawal there.

Withdrawal policy#

The following section is the statutory policy. It reproduces the statutory model notice from Annex 1 to Article 246a § 1 (2) sentence 2 EGBGB; the German wording is the operative one.

Right of withdrawal#

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form for this, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal#

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the service should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your exercise of the right of withdrawal from this contract, in comparison with the full coverage of the contract.

Early lapse of the right of withdrawal#

For the subscription#

The subscription is a digital service. Your right of withdrawal lapses under § 356 Abs. 5 BGB on the complete performance of the service, if, before performance begins, you have

  1. expressly consented to us starting performance before the withdrawal period expires, and
  2. confirmed that you lose your right of withdrawal on our complete performance of the contract.

We obtain both when you order. As long as the service has not been fully performed, your right of withdrawal remains, and for the time used up to the withdrawal you owe only the proportionate compensation under the section above.

For credits bought on top#

Credits bought on top are digital content supplied immediately. Your right of withdrawal lapses here under § 356 Abs. 6 BGB if

  1. we have begun performance of the contract,
  2. you have expressly consented to us beginning before the withdrawal period expires,
  3. you have confirmed that you thereby lose your right of withdrawal, and
  4. we have provided you with a confirmation of the contract under § 312f BGB on a durable medium.

We send you this confirmation as an order confirmation by email.

If you want to withdraw from the contract, fill in this form and send it to support@dory-ai.com or by post to the address given below. Using the form is not obligatory; an informal, unequivocal statement is enough.
